4. 1. This matter is taken up through hybrid mode.
2. None appears for the Petitioner at the time of call.
3. Judgment dated 19th January, 2017 passed by learned Judge, Family Court, Khurda in Criminal Petition No.57 of 2014 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay monthly maintenance of Rs.5,000/- to Opposite Party No.1 and Rs.2,500/- to Opposite Party No.2 from the date of filing of the application, i.e., from 30th May, 2014.
4. Mr. Omkar Panda, learned counsel appearing on behalf of Ms. Pratyusha Naidu, learned counsel submits that they have no instruction in the matter, as the brief has been taken back by the Petitioner.
5. Mr. Pattnaik, learned counsel for the Opposite Parties is present.
6. Since none appears for the Petitioner to pursue the matter, the RPFAM stands dismissed for non-prosecution.
7. Interim order dated 4th September, 2017 passed in Misc. Case No.241 of 2017 stands vacated.
