01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard.
3. The Petitioner has filed this Writ Petition seeking to quash the order under Anenxure-10 so far as it relates to the Petitioner and to direct the Opposite Parties to regularize the service of the Petitioner in the post of Peon taking into account his initial date of appointment under Opposite Party No.3 within a stipulated period.
4. Learned Counsel for the Petitioner contended that the case of the Petitioner is covered by the ratio of the judgment of this Court in the case of Rajendra Kumar Nayak v. Orissa Mining Corporation Ltd. & others, 2017 (II) ILR CUT-912.
5. In view of the above, the impugned order under Annexure-10 so far as it relates to the Petitioner is quashed and the matter is remitted back to the authorities to re-consider the case of the Petitioner for regularization in terms of the judgment of this Court // 2 //
in the case of Rajendra Kumar Nayak (supra), within a period of four months from the date of Communication of the Order.
