  02.       1.      Even though the application was entertained in the year

2015, no such counter affidavit has been filed as yet.

2. This application involves the following relief:-

"RELIEF(S) SOUGHT FOR:

It is, therefore, humbly prayed that this Hon'ble Tribunal may graciously be pleased to:

(i) direct the respondents to regularize the services of the applicants with effect from their initial date of engagement;

(ii) direct the respondents to give the applicants pension and other pensionary benefits treating the entire period of service as regular employees;

(iii) and may pass such other order/ orders as deemed just and proper.

And for this act of kindness, the applicants shall as in duty bound ever pray."

3. Attempting to satisfy his case learned counsel for the Petitioners took reliance of a decision of this Court given in

// 2 //

WPC(OAC) No.864 of 2018 as reported in 2022(I) OLR 266. No such counter affidavit has been filed as yet.

4. Considering the submission made by the learned counsel for Petitioners, this Court remits the matter to the Opposite Party No.1 to consider the grievance of the Petitioners and decide their fate keeping in view the decision vide 2022(I) OLR 266.

5. The entire exercise shall be completed within a period of two months from the date of communication a certified copy of this order along with a copy of the writ application so also the judgment referred to hereinabove.

6. The WPC(OAC) stands disposed of with the above order.
