01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. Heard learned counsel for both the parties.

3. The writ petition has been filed with the following relief:

"It is therefore prayed that Your Lordship be graciously pleased to issue Rule NISI calling upon the Opp. Parties to show cause as to why the writ in the nature of mandamus or any other writ/writs shall not be issued directing the op. parties to regularize the service of the petitioner from the date when he completed ten years as casual/daily wage employee in the Department with all consequential benefits as due and admissible."

It is submitted by learned counsel for the Petitioner that the facts of the present case is identical in the matter of Babula Pradhan vs. State of Odisha and others in W.P.(C) No.36020 of 2021, disposed of on 22.11.2021. Accordingly, learned counsel for the Petitioner prays for a direction to the Authorities to consider the case of the Petitioner in the light of the order of this case in the case of Babula Pradhan (supra).

5. Learned counsel for the State submits that he has no objection if a direction is given to the Opposite Party No.3 to consider the case of the Petitioner in accordance with law and in the light of the order of this Court in the case of Babula Pradhan (supra).

Considering the limited nature of grievance, this Court while disposing of the writ petition directs the Petitioner to file a fresh representation along with copies of the judgment relied upon by the Petitioner as well as any other relevant documents taken support of along with the certified copy of this order within a period of two weeks hence, in such event, the Opposite Party No.3 shall do well to consider the case in accordance with law, taking into account the judgment of this Court in the case of Babula Pradhan (supra) and others and disposed of the same by passing a speaking and reasoned order within a period of three months from the date of such representation. Decision so taken on the representation shall be communicated to the Petitioner within a period of two weeks thereafter.

7. With the above direction, the writ petition stands disposed of.

8. Issue urgent certified copy as per rules.
