03. 1. Learned counsel for the Petitioner urges that since the co-
accused have all been acquitted, the case against the present Petitioner should be quashed.
2. The case against the present Petitioner could not proceed because of the stay order passed by this Court. But for the stay order, it is possible that judgment would have been passed by the trial Court in the case of Petitioner as well.
3. Consequently, permitting the Petitioner to urge all the pleas as may be available to him in accordance with law before the trial Court, the petition is disposed of. The interim order passed earlier stands vacated. A copy of this order be communicated to the concerned Court below forthwith.
