05. 1. This matter is taken up through hybrid mode.
2. Heard Mr. P.K. Nayak, learned counsel appearing for the Applicant.
3. For condoning the delay of 78 days in filing the appeal challenging the ex parte judgment dated 14.12.2021 passed by the Judge Family Court, Sambalpur in C.P. No.32 of 2021, this application under Section 5 of the Limitation Act has been filed.
4. Despite due notice from this Court, the Respondent prefers not to participate in the proceeding.
5. We have perused the petition to find the causes as assigned for explaining the delay. We are satisfied that the delay has been sufficiently explained and accordingly, the prayer for condonation of the said delay stands allowed.
6. In the result, the application stands allowed and disposed of.
