2. Mr. S.K. Behera, learned counsel submits that Mr. Sudarsan Behera and associates have instructions to appear on behalf of opp. party no.3 and they will file counter affidavit along with Vakalatnama in course of the day and copy of the counter affidavit has been served on learned counsel for the petitioner as well as learned State Counsel in Court today.

3. Mr. P.K. Behera, learned counsel submits that Mr. D.R. Sundar Ray, learned counsel has filed Vakalatnama on behalf of the opp. party no.4 on 12.08.2022 and two weeks time may be granted to file counter affidavit in the case.

4. Mr. H. Mohanty, learned counsel submits that they have instructions to appear on behalf of opp. party no.5 and they will file Vakalatnama in course of the day and require two weeks time to file counter affidavit. He prays that the copies of the counter affidavit filed on behalf of opp. party no.3 may be served on him.

5. Mr. S.S. Pradhan, learned Addl. Govt. Advocate for the

opp. party nos. 1 and 2 relying on the decision of this Court in the case of Alok Chandra Mohanty vs. State of Orissa and others reported in 2004 (I) OLR 256, submits that the case is not maintainable before this High Court and remedy lies before State Education Tribunal. Copy of the judgment be kept in the record.

6. List this case on 06.09.2022. Counter affidavits, if any, shall be filed by the opp. parties in the meanwhile.
