03. 1. This is an application for exemption from payment of Court fee.

2. Heard Mr. B. N. Samantaray, learned counsel for the Appellant.

3. Considering the submissions made on behalf of the Appellant, the prayer to exempt the Appellant from payment of required Court fees of Rs.7,324/- is allowed for the time being pending appeal.

4. I.A. is disposed of.

5. Issue notice to the Respondents on the question of limitation.

6. Since Respondent No.2-Insuracne Company has filed MACA No.963/2018 against the same judgment which is connected to the present appeal, learned counsel for the Appellant is permitted to serve one extra copy of the appeal memo on the counsel appearing in the connected case for the Insurance.

7. Notice be issued to the Respondent No.1 by registered post with A.D. fixing a short returnable date. Requisites shall be filed within three days.

8. List this matter on 20th December, 2021 along with MACA No.963 of 2018.
