Judgement Date : 21 June, 2021
W.P.C.(OAC) No.2272 of 2015
02. 21.06.2021 This matter is taken up through Video
Conferencing mode.
Heard Mr.L.K.Mohanty, learned counsel for the
petitioners-applicants and Mr.Panigrahi, learned Counsel for
the State-respondents.
A fair statement is made by Sri Mohanty,
learned counsel for the petitioners-applicants that the case of
this nature involving similarly situated persons have already
been disposed of by the State Administrative Tribunal in
favour of applicants therein in disposal of O.A. No.1106(c) of
2015 but however there is challenge to the above judgment
of the Tribunal by the State Authority, which is pending
before the Division Bench of this Court by way of W.P.(C)
No.29224 of 2020.
For the opinion of this Court and for the
pendency of this Writ Petition involving same dispute for the
decision of the Division Bench involving Tribunal judgment,
this matter should await the outcome in W.P.(C) No. 29224
of 2020. The Registry is directed to keep a watch of the
W.P.(C) No. 29224 of 2020 and list this matter accordingly.
Liberty is also granted to Mr.L.K.Mohanty,
learned counsel for the petitioners-applicants and Mr.
Panigrahi, learned ASC for the State for making attempt in
listing this matter immediately after disposal of the W.P.(C)
No.29224 of 2020.
