Heard Mr. J.K. Khuntia, learned counsel for the petitioner.
Against rejection of the claim with regard to
compassionate appointment vide order dated 02.03.2021 under
Annexure-7, the petitioner approached this Court by filing the
present writ petition.
Mr. J.K. Khuntia, learned counsel for the petitioner
contended that the case of the petitioner is fully covered by the
judgment of this Court in the case of Damodar Jena v. M.D.
GRIDCO, 2015 (II) ILR CUT 569. But without considering the
same in proper perspective, the claim of the petitioner has been
rejected which is contrary to the provisions of law.
Issue notice to the opposite parties.
Four extra copies of the writ petition be served on
learned State Counsel appearing for opposite parties no.1 to 4
within three days enabling him to obtain instructions or file
counter affidavit.
As the restrictions due to resurgence of COVID-19
situation are continuing, learned counsel for the parties may
utilize a print out of the order available in the High Court's
website, at par with certified copy, subject to attestation by the
concerned advocate, in the manner prescribed, vide Court's
Notice No.4587 dated 25th March, 2020, as modified by Court's
notice no. 4798 dated 15th April, 2021.
