The petitioner has filed this writ petition to quash the order dated 21.04.2016 under Annexure-5 passed by opposite party no.2, by which the claim of the petitioner for compassionate appointment has been rejected on the ground that Rehabilitation Assistance Scheme is not applicable to the Block Grant employees. Perused the record. It appears that the claim of the petitioner for compassionate appointment has been rejected on the ground that Rehabilitation Assistance Scheme is not applicable to the Block grant employees. The said stand of the opposite parties is no more res integra in view of judgment passed by the Court in Ritanjali Giri @ Paul v. State of Odisha (School & M.E. Deptt.) & others, 2016 (I) ILR-1162.

In that view of the matter, the order dated 21.04.2016 under Annexure-5 rejecting the claim of the petitioner for compassionate appointment is quashed. Accordingly, this Court directs the opposite parties to consider the case of the petitioner for compassionate appointment keeping in view the judgment Ritanjali Giri @ Paul (supra) within a period of three months from the date of production/communication of the authenticated copy of this order.

With the above observation and direction, the writ petition is disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
