Heard Mr. H.L. Shangreiso, learned Senior counsel assisted by Mr. A. Syiem, learned counsel for the petitioners and Mr. V.K. Jindal, learned Senior counsel assisted by Mr. V.K. Kumar, learned counsel for the respondents.

The petitioners are aggrieved with the notice dated 22.08.2022, whereby the employees (Executives and Supervisors) governed by the NEEPCO CDA Rules have been directed to withdraw from the membership of the Trade Unions within 48 hours and confirm the same, failing which action as deemed fit shall be taken as per Rules.

The concern of the petitioners in this writ petition is that the issue of insertion of Rule 8(iii) in the NEEPCO CDA Rules is presently seized by this Court in WP(C) No. 367 of 2021, and the matter was finally heard on 23.08.2022, and is pending for filing of final written arguments. It is submitted that the issuance of this order seeks to take away the entire basis of the writ petition which is pending adjudication before this Court, as such it has been prayed that appropriate orders be passed.

Mr. V.K. Jindal, learned Senior counsel assisted by Mr. V. Kumar, learned counsel for the respondents submits that the order was issued in the normal course as the writ petition has been filed since 2021, coupled with the fact that the entire trade union activities have been stalled.

Be that as it may, as the matter is to be concluded and awaiting for final judgment and order in WP(C) No. 367 of 2021, the issuance of such order to the mind of the Court is misplaced. Accordingly, the same is stayed till further orders.
