[1] Mr. S. Nepolean, learned G.A. assisted by Mrs. RK. Emily, learned Dy. G.A. for the State respondent, prays for 3 (three) weeks' time for filing counter affidavit. [2] Mr. N. Zequeson, learned counsel for the petitioner, submits that State respondent has already been given ample opportunities for filing counter affidavit and this may be the last chance and also draws the attention of this Court to para 21 of the judgment reported as (2015) 7 SCC 291 which stipulates that without issuing a chargesheet, the period of suspension cannot be extended automatically after 3 (three) months. [3] In the counter affidavit, State respondent has to state whether chargesheet has been issued or not. [4] List this case on 29.11.2024.
