                     PRAYER:- Writ Petition filed under Article 226 of the Constitution of
                     India praying to issue a Writ of Mandamus, directing the respondents 1 to
                     4 to subdivide property at Survey Nos.550/4 and 550/5 of Koosalipatti
                     Village, Kovilpatti Taluk, Thoothukudi District in accordance with title
                     deeds and enjoyment of respondents 5 and 6 and ensure pathway right of
                     common people of Koosalipatti Village in the remaining property at
                     Survey Nos.550/4 and 550/5 of Koosalipatti Village, Kovilpatti Taluk,
                     Thoothukudi District on the basis of representation given by the
                     petitioner dated 21.08.2025 within stipulated period.

This Writ Petition is filed seeking a direction to the

respondents 1 to 4 to subdivide property at Survey Nos.550/4 and 550/5

of Koosalipatti Village, Kovilpatti Taluk, Thoothukudi District in

accordance with title deeds and enjoyment of respondents 5 and 6 and

ensure pathway right of common people of Koosalipatti Village in the

remaining property at Survey Nos.550/4 and 550/5 of Koosalipatti

Village, Kovilpatti Taluk, Thoothukudi District, on the basis of

representation given by the petitioner dated 21.08.2025 within stipulated

period.

2. The main grievance of the petitioner is that, while granting

patta in favour of respondents 5 and 6, patta has been granted for a larger

extent of land. Therefore, the petitioner submitted a representation dated

21.08.2025 seeking subdivision of the subject property and grant of patta

to the respondents 5 and 6 in accordance with their title deeds and

possession and for classification of the remaining portion of the property

as a pathway. However, no action has been taken so far. Hence, the

petitioner has filed this Writ Petition.

3. Heard the learned Special Government Pleader appearing for

the respondents 1 to 4.

4. Considering the facts and circumstances of the case, this

Court is of the view that the relief sought in this Writ Petition clearly

indicates that the petitioner is attempting to achieve, by way of this Writ

Petition, what could not be achieved directly before the civil Court.

Hence, this Court does not find any merit in the Writ Petition. If the

petitioner claims any right of access, it is open to him to file an

appropriate suit and establish the same before the competent civil Court.

5. With the above observations, this Writ Petition is dismissed.

There shall be no order as to costs.
