                Order IV Rule 1 of O.S.Rules to pass Judgment and Decree in favour of the
                Plaintiff and against the Defendant:
                          i) To direct the defendant to make payment of the advance amount of
                Rs.8,00,00,000/- (Rupees Eight Crores only) admittedly received by him
                towards sale of the schedule property, with interest at the rate of 12% per
                annum from the date of filing of the suit till the date of realization of the decree
                amount
                          ii) To direct the defendant to pay the cost of the suit

                                                       JUDGMENT

Today, the learned counsel appearing for the plaintiff and the learned

counsel appearing for the defendant are present and submitted that the matter

has been settled amicably between the parties and to that effect the learned

counsel appearing for the plaintiff has made an endorsement.

2. Accordingly, the present Suit is dismissed as settled Out of Court and

the Registry is directed to refund the full court fee to the plaintiff, as per Rules.

Consequently, connected miscellaneous petitions are closed. There shall be

no order as to costs.
