                                                   ORDER

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.]

The prayer in the petition is to quash the impugned order passed by the

second respondent in No.114/Tha.ku.2/2026 dated 30.01.2026 and direct the

respondents 1 and 2 to grant 15 days emergency leave to the petitioner's senior

paternal father Veeranasami, S/o.Ramakaran PID No.10961.

2. It is the case of the petitioner that his paternal uncle was

convicted under Section 302 of IPC and sentenced to undergo life

imprisonment in S.C.No.24 of 2008 by the Additional Mahila Court, Madurai.

While being so, the life convict's wife fell ill and as such the petitioner who is

being neighbour submitted representation seeking emergency leave, however it

was rejected on the ground that the convict is facing another case for the

offence under Sections 294(b), 323,324 and 326 of IPC in C.C. No.88 of 2008

on the file of the Judicial Magistrate Court, Melur.

3. Considering the fact that the wife of the convict fell ill and

except the convict there is nobody to take care of his wife. this Court is

inclined to grant six days emergency leave to the convict without escort.

4. Accordingly, the impugned order passed by the second respondent

is set aside and writ petition is disposed of with the following directions:

(i) The respondents are directed to grant six days

emergency leave without escort to the convict prisoner

namely, Veeranasami, S/o.Ramakaran PID No.10961.

from 02.03.2026 to 07.03.2026. The convict prisoner

shall be released from the prison on 02.03.2026 at 6.00

am.,

(ii) He shall report back to the Superintendent of Prison,

Central Jail,Madurai / second respondent, by

07.03.2026 at 6.00pm..,

(iii) The petitioner shall produce all necessary documents,

along with a copy of this order, before the jail

authorities,

(iv) The convict shall report before the fourth respondent

daily at 5.30 pm., till the completion of leave period.

(v) During the leave period, the convict prisoner shall

abide by all the conditions prescribed in the Jail

Manual. Consequently connected miscellaneous

petition stands closed.
