PRAYER: Writ Petition filed under Article 226 of the Constitution of India for
issuance of Writ of of Certiorarified Mandamus, to call for the records
pertaining to the Impugned Order passed by the third respondent in
C.No.A1(2)/19122/2016 dated 16.09.2016 and quash the same and
consequently direct the respondents Nos.2 & 3 to regularization of the service

seniority and give notional promotion and revise the pension with monetary
benefits equal to the post of Inspector of Police rank to the petitioner.

ORDER
This Writ Petition has been filed challenging the impugned order dated
16.09.2016 passed by the third respondent rejecting the petitioner’s request to
revise and regularize his service seniority and give notional promotion with
monetary benefits equal to the rank of Inspector of Police to the Petitioner.
2. It is now brought to the notice of this Court by the learned Special
Government Pleader appearing for the respondents which is also supported by
the learned counsel appearing for the petitioner that the issue raised by the
petitioner in this Writ Petition regarding the fixation of seniority is now under
consideration before the Hon’ble Supreme Court in S.L.P.No.6986 of 2018 and
the said S.L.P. is still pending. In similar circumstances, another learned Single
Judge of this Court in W.P.(MD).No.17111 of 2019, dated 02.03.2022, disposed
of the Writ Petition, wherein, a similar relief was sought granted liberty to the
petitioner therein to seek for the same relief based on the judgment to be
rendered by the Hon’ble Supreme Court in S.L.P.No.6986 of 2018.

3. Since the petitioner is also a similarly placed person to that of the
petitioner in W.P.(MD).No.17111 of 2019, similar order should be passed.
4. Accordingly, the Writ Petition is disposed of by granting liberty to the
petitioner to seek for the very same relief depending upon the judgment of the
Hon’ble Supreme Court to be delivered in S.L.P.No.6986 of 2018. No costs.
