When the appeal came up for hearing on 11.09.2024, there was no

representation for the appellant. Hence, the matter was directed to be

listed under the caption 'for dismissal' on 26.09.2024. Accordingly, the

appeal was listed on 26.09.2024 and it was adjourned.

2. Today also, the appeal is listed under the caption 'for dismissal'.

However, when the appeal is taken up for hearing, there is no

representation for the appellant. Despite giving sufficient opportunity,

the learned counsel for the appellant has not come forward to prosecute

the appeal. The learned counsel for the respondent is present. In view of

the same, the Civil Miscellaneous Appeal is dismissed for non-

prosecution. No costs. Consequently, connected Miscellaneous Petition

is closed.
