                                                        JUDGMENT

(Judgement of the Court was made by R.SUBRAMANIAN, J.)

A illegal retrospective promotion that was granted to the appellant / writ

petitioner resulted in the order of recovery. The Writ Court has refused to

interfere with the order of recovery on the ground that the promotion granted to

the appellant / writ petitioner is totally illegal, as it even predates the actual date

on which the appellant joined the 3rd respondent Panchayat. We, therefore, see

no merit in the writ appeal. The Writ Appeal fails and it is accordingly

dismissed. No costs. Consequently, connected miscellaneous petition is

closed.
