When the matter came up for hearing, the learned counsel for the

appellant would state that the issue involved in this appeal has become

infructuous and thus, the appeal may be dismissed as infructuous.

Learned counsel for the appellant has also made an endorsement to that

effect.

2. In view of the above submission and endorsement made by the

learned counsel for the appellant, the Civil Miscellaneous Appeal is

dismissed as infructuous. No costs. Consequntly, connected
