                                                            JUDGMENT

(Delivered by Dr. ANITA SUMANTH.,J) Nothing survives in this appeal, as the impugned order has only given

effect to the directions of the Commissioner of Income Tax under Section

263 of the Income Tax Act, 1961 revising the original assessment. As

against the order of revision of the Commissioner of Income Tax dated

24.03.2010, the assessee has filed an appeal in I.T.A.No.1373/Mds/2012

and on 22.08.2012, the appeal had come to be allowed.

2. As against the order of the Tribunal allowing the assessee's appeal,

the revenue has filed Tax Case (Appeal) in T.C.(A)No.328 of 2011 that had

come to be dismissed on 05.02.2019. Learned Standing Counsel confirms

that this order has attained finality and no SLP has been filed.

3. In view of the same, there is no merit in the present appeal and

recording the aforesaid trajectory of events, this appeal is dismissed

returning the questions of law unanswered. No costs.
