                 PRAYER IN S.A(MD)No.SR 59029 of 2023: Second Appeal is filed under

                 Section 100 of Code of Civil Procedure, to set aside the impugned Judgement and

                 Decree dated 17.08.2015 passed in A.S.No.35 of 2010 on the file of the Sub

                 Court, Ramanathapuram, confirming the judgment and decree dated 21.04.2010

                 passed in O.S.No.90 of 2007 on the file of the District Munsif Cum Judicial

                 Magistrate, Thiruvadanai, Ramathapuram and to allow the present Second

                 Appeal.

                                                         ORDER

This petition is filed to condoning the delay of 1925 days in preferring the

second appeal in S.A(MD)SRNo.59029 of 2023.

2. The records show that there was no representation for the petitioner,

when the matter was listed on 20.09.2023 and again on 04.10.2023. Therefore,

this Court directed on 04.10.2023 that this matter be listed for dismissal under the

caption 'for dismissal'. Accordingly, the case is listed today under the caption 'for

dismissal'. Today, also there is no representation for the petitioner. Therefore,

this Civil Miscellaneous Petition is dismissed for non prosecution. Consequently,
