PRAYER : Review Application has been filed under Order XLVII Rule 1 read
with Section 114 of C.P.C., to review the order passed in W.A.(MD) No.1385
of 2011, dated 15.02.2023 and allow the Review Application.

Review Application is filed on the ground that this Court has not
considered the dictum laid by the Hon'ble Supreme Court of India in the case of
T.K.Ponnusamy and Others Vs. Government of Tamil Nadu and others
reported in 1994 Suppl. (3) SCC 376.

2. On perusing the judgment, it is clear that this Court has taken note of
the said judgment and has discussed about it in detail in para (16) and
distinguished how the case does not fall within the principle laid by the Hon'ble
Supreme Court of India in T.K.Ponnuswamy's case.
3. Hence, this Court finds no new facts for reviewing the earlier petition.
Accordingly, Review Application is dismissed at the SR stage itself.
Consequently, connected miscellaneous petition is closed.
