PRAYER: The Writ Petition has been filed under Article 226 of the
Constitution of India praying to issue a Writ of Declaration, to declare that
the Regulation 5(5)(ii)(a) of the Tamil Nadu Electricity Supply Code 2004
is unreasonable arbitrary illegal violative of Constitution of India and
without jurisdiction.

ORDER
The Writ Petition has been preferred for declaring Regulation
5(5)(ii)(a) of the Tamil Nadu Electricity Supply Code 2004 as unreasonable
and arbitrary. The matter is no longer res integra. The very same issue was
taken up by the Division Bench of this Court in the case of Sidhi Smelters
Private Limited rep. by its Executive Director & another Vs. the Tamil
Nadu Electricity Board rep. by its Chairman & others reported in CDJ
2007 MHC 4297. The Division Bench upheld levying of additional security
deposit and considered the request of the payment of the additional security
deposit in installments. In the present case also, the petitioner has
challenged Regulation 5(5)(ii)(a) of the Tamil Nadu Electricity Supply
Code 2004.
2. In line of the judgment passed by the Division Bench of this
Court, while dismissing this Writ Petition, this Court is inclined to grant
permission to the petitioner for paying the additional security deposit in
installments.

With the above direction, the Writ Petition is dismissed. There
shall be no order as to costs.
