AND N.SATHISH KUMAR, J.

The learned counsel appearing for the appellant would submit that

despite his repeated letters, the appellant has not contacted him. He has

reported no instructions. The learned counsel has also produced the

acknowledgement to show that the letters have been served on the appellant

intimating the fact that the appeal is listed for hearing.

2. Hence, we find that the appellant is not interested in prosecuting the

case. Therefore, this appeal is dismissed for non-prosecution. No Costs.

Consequently, connected Miscellaneous Petition is closed.
