JUDGMENT
The present Second Appeal has been filed challenging the judgment and
decree dated 27.01.2014 passed in A.S.No. 101 of 2011 on the file of the
Principal Sub Court, Karur confirming the judgement and decree dated
17.03.2011 passed in O.S.No.188 of 2005 on the file of the Additional District
Munsif Court, Karur.
2. The plaintiffs are the appellants in the Second Appeal.
3. The suit in O.S.No. 188 of 2005 has been filed for partition.
4. Learned counsel for the appellants would submit that this Court had
ordered notice of motion returnable in eight weeks on 20.08.2015 and
subsequent to the notice ordered by this Court, the first appellant [email protected]
kaliammal passed away and the legal heirs of the first appellant have been
impleaded as the third and fourth appellants and that the appellants and the
respondent being siblings, the matter was compromised between the parties due
to the intervention of relatives and elders in the family. He would further submit
that pursuant to compromise, the respondents have agreed to pay
Rs.20,00,000/- to the appellants and thereby, they paid 10 lakhs to the second
appellant Rukmani and Rs.5 lakhs each to the third and fourth appellants.

5. The learned counsel for the appellants would submit that apart from the
properties covered under the suit, the parties have compromised in respect of
two other properties and they have also been included in the joint memo of
compromise and he would pray that the joint memo of compromise may be
accepted and the appeal may be disposed of in terms of joint compromise of
memo.
6.The learned counsel for the respondent would submit that the matter
has been compromised and the parties have entered into joint compromise
memo.
7.The parties are present before this Court and they have also been
identified by the respective counsels and the Registrar Judicial has also filed a
report after verifying the identity and credentials. The relevant portion of the
joint memo of compromise is extracted hereunder:-
"1) It is submitted that the above Second Appeal in S.A(MD)No.447 of 2015 has been filed challenging the Judgment and Decree dated 27.01.2014 passed in A.S.No.101 of 2011 on the file of Principal Subordinate Court, Karur confirming the Judgment and Decree dated 17.03.2011 passed in O.S.No.188/2008 on the file of the Additional District Munsif Court, Karur.

2) It is submitted that the Appellants 1 and 2 in the above second appeal have filed the suit in O.S.No.188 of 2008 on the file of the Learned Additional District Munsif Court, Karur, seeking the relief of partition in respect of the suit schedule properties. The Trial Court has dismissed the suit by judgment and decree dated 17.03.2011. Aggrieved over the same, the appellants herein preferred an appeal in A.S.No.101 of 2011 on the file of the Learned Principal Subordinate Judge, Karur and the appeal was also dismissed by the lower appellate court on 27.01.2014.
3) It is against the concurrent judgment of the Courts below, the appellants have preferred the above appeal and this Hon’ble Court has admitted the above appeal.
4) It is submitted that pending the above Second Appeal, the 1 st appellant namely Pappayee @ Kaliyammal died on 22.05.2017 and steps had been taken. By virtue of the order passed in C.M.P.(MD)No. 9697 of 2018 dated 19.02.2020, the Appellants 3 to 4 had been brought on record.
5) It is submitted that pending the Second Appeal, after various round of deliberations with the advice of well wishers, the respective parties having regard to the relationship between them being brothers and sisters have arrived at an amicable settlement on the following terms.
a)The Respondents have agreed to pay a sum of Rs.20,00,000/-(Rupees Twenty Lakhs only) to the Appellants towards their share. The 2nd appellant has now received a sum of Rs.10,00,000/- (Rupees Ten Lakhs Only) by way of Demand Draft Nos.535027 & 175983. Likewise the 3 rd appellant has now received a sum of Rs.5,00,000/- (Five Lakhs Only) by way of Demand Draft No.535026 & 175984. Similarly, the 4th appellant has now received a sum of Rs.5,00,000/- (Five Lakhs Only) by way of Demand Draft No.535025 & 175985 before this Honourable court, when this Joint Compromise memo is being recorded.

b)The above said amount of Rs.20,00,000/- has been paid in the following manner:- 1st respondent viz., K. Nagulsamy hereby pays Rs. 5,00,000 (Rupees Five Lakhs only) to the 2nd appellant viz., Rukmani by way of Demand Draft No.535027 drawn on State Bank of India, Karur Bazaar Branch, Karur dated 28.07.2021. Likewise, 1st respondent viz., K. Nagulsamy hereby pays Rs.2,50,000/- (Rupees Two Lakhs Fifty thousand only) to the 3rd appellant viz., Arunachalam by way of Demand Draft No.535026 drawn on State Bank of India, Karur Bazaar Branch, Karur dated 28.07.2021. Likewise, the 1st respondent viz., K. Nagulsamy hereby pays Rs.2,50,000/- (Rupees Two Lakhs Fifty thousand only) to the 4th appellant viz., Pushpa by way of Demand Draft No.535025 drawn on State Bank of India, Karur Bazaar Branch, Karur dated 28.07.2021.
c)Similarly the 2nd respondent viz., K. Chokkalingam hereby pays Rs. 5,00,000 (Rupees Five Lakhs only) to the 2nd appellant viz., Rukmani Demand Draft No.175983 drawn on Pragati Krishna Gramin Bank, Aralihally Branch, Bellary dated 26.07.2021. Likewise, the 2nd respondent viz., K. Chokkalingam hereby pays Rs.2,50,000/- (Rupees Two Lakhs Fifty thousand only) to the 3rd appellant viz., Arunachalam by way of Demand Draft No.175984 drawn on Pragati Krishna Gramin Bank, Aralihally Branch, Bellary dated 26.07.2021. Likewise, the 2 nd respondent viz., K. Chokkalingam hereby pays Rs.2,50,000/- (Rupees Two Lakhs Fifty thousand only) to the 3rd appellant viz., Pushpa by way of Demand Draft No.175985 drawn on Pragati Krishna Gramin Bank, Aralihally Branch, Bellary dated 26.07.2021.
d) The Appellants 2 to 4 have agreed to receive the said sum of Rs. 20,00,000/-(Rupees Twenty Lakhs only) towards their claim in the suit and agreed to confirm the Judgment and Decree dated 27.01.2014 passed in A.S.No.101 of 2011 on the file of Principal Subordinate Court, Karur confirming the Judgment and Decree dated 17.03.2011 passed in O.S.No.188/2008 on the file of Additional District Munsif Court, Karur.

e)Having regard to the receipt of Rs.20,00,000/-(Rupees Twenty Lakhs only) by the Appellants No. 2 to 4 towards their share as specified in clause b & c, they hereby relinquish their entire right and interest in respect of the schedule of properties described hereunder.
f)It is further agreed by the appellants that having regard to the receipt of Rs.20,00,000/- /-(Rupees Twenty Lakhs only) towards their share in respect of the suit schedule properties they hereby specifically undertakes that neither themselves nor their heirs or representatives or agents will not make any claim whatsoever in respect of the schedule of properties described hereunder in future.
g)In view of the compromise entered between the parties the Appellants Nos. 2 to 4 have agreed to confirm the Judgment and Decree dated 27.01.2014 passed in A.S.No.101 of 2011 on the file of the Principal Subordinate Court, Karur confirming the Judgment and Decree dated 17.03.2011 passed in O.S.No.188/2008 on the file of the Additional District Munsif Court, Karur.
h)The parties have entered into the above compromise on their own volition without any coercion whatsoever.
i)In view of this compromise entered between them, both the appellants and the respondents hereby agree to dispose the above second appeal by passing a Judgment and decree in S.A.(MD) No.447 of 2015 in terms of this joint compromise memo.

8. Pursuant to the joint memo of compromise the demand draft has also
been handed over to the appellants and they have received the same in the
presence of the respective counsels and they have also acknowledged the same.
Further, it is seen that the parties have also compromised in respect of two
other properties, which are not covered in the suit but, included in the joint
compromise memo and it requires registration and therefore, the learned counsel
for the parties would pray that the suitable orders may be passed regarding the
same.
9. In view of the compromise arrived at between the parties the second
appeal is disposed of. No costs. The terms of compromise shall form part of
decree. The parties are at liberty to register the decree before the jurisdictional
Sub Registrar in accordance with the provisions in the Registration Act.
