                     Ramanathapuram.

                                                      JUDGMENT

When the matter was came up for hearing, the learned counsel

appearing for the appellant submits that the matter has been settled

out of Court and he has produced a letter of the appellant's son dated

17.11.2021, in which, it is stated that the appellant died on

10.08.2020 and they have settled the matter amicably between

themselves.

2. The said fact was not disputed by the learned counsel

appearing for the respondent.

3. Recording the same, this Second Appeal is disposed of as

settled out of Court. Consequently, connected miscellaneous petition

is closed. There shall be no order as to costs. The appellant is

entitled for refund of half of the Court fee.
