                                                 JUDGMENT

The appellant/plaintiff has filed the present second appeal against

the judgment and decree of the learned VII Additional Judge, City Civil

Court, Chennai made in A.S.No.702 of 2007 dated 21.04.2008

confirming the judgment and decree of the learned IX Assistant Judge,

City Civil Court, Chennai made in I.A.No.12066 of 2005 in O.S.No.6557

of 2001 dated 20.06.2006.

2.Mr.Rajarajan, learned representing counsel for Mr.D.Rajasekar,

submits that the sole appellant has died and therefore this appeal may be

dismissed as having abated. Mr.S.Vijayakumar, learned counsel for the

respondent has also no objection.

3.Recording the submissions made by the learned representing

counsel for the appellant, this Second Appeal is dismissed as abated. No

costs.
