                                                  COMMON JUDGMENT

                               It was reported on the last occasion that the sole appellant was

                     dead and steps have to be taken to bring on record the legal

                     representatives. Learned counsel for the appellant would submit that

                     despite his best efforts, legal representatives of the deceased appellant

                     could not be contacted.




                               2. In view of the said submission, the second appeals are

                     dismissed as abated. Liberty is however given to learned counsel for

                     the appellant to file necessary application if the legal representatives

                     of the deceased appellant approach him, subject to the respondents

                     questioning the delay. Consequently, M.P.No. 1 of 2009 is also

                     dismissed.
