                                 JUDGMENT

(Heard Video Conference)

The learned counsel for the appellant submits that despite her best

efforts to contact the appellant, till date, she has been unable to do so and

the letter sent by her to the appellant has also not been responded. On

the last hearing, i.e., 13.07.2021, the learned counsel for the respondent

submitted that both the appellant as well as the respondent are dead.

2. From the submissions of the learned counsel for the appellant as

well as the submissions made by the learned counsel for the respondent

on the last hearing date, it can be inferred that the appellant is not

interested to prosecute this Second Appeal. If he was interested, he would

have certainly contacted the appellant as the Second Appeal is of the year

2002. Accordingly, the Second Appeal is dismissed for non prosecution.

No costs. Consequently, connected miscellaneous petition is closed.
