                                                         JUDGMENT

Challenge in this writ appeal is to the order of the writ court

dated 17.10.2012 made in W.P.No.28100 of 2012, which was filed

challenging the proceedings of the second respondent dated

13.09.2011 so far as it relates to Clause 22 of the same and the

proceedings dated 09.02.2012 of the third respondent, and quash the

same and for a direction to the respondents 1 to 4/appellants to

promote the writ petitioner as B.Ed. Middle School Headmaster.

2. The writ petition was allowed directing the

respondents/appellants herein to promote the writ petitioner as Middle

School Headmaster by treating the Diploma in Teacher Education as

equivalent to +2 course, provided the petitioners were not otherwise

disqualified. The appeal has been preferred in July 2013 even before

which the order passed in the writ petition was given effect to by the

proceedings of the third respondent vide proceedings in

Na.Ka.No.1680/A5/2013 dated 02.07.2013. Subsequent to that

G.O.Ms.No.165 School Education SE 3(1) Department, dated

15.10.2014 was also issued, whereby a diploma in Teachers Training is

to be treated as equivalent to higher secondary course (+2). The

translated version of the relevant portion of the G.O. is as follows:

“The Government has considered the proposal sent by the Director of School Education carefully and since order has been issued by the High Court, Madras recognising 10 th Std. SSLC with two years Diploma in Teacher Education as equivalent to +2 qualification, has decided to accept the verdict and to issue orders recognising 10th Std. SSLC with two years Diploma in Teacher Education which are obtained before July 1987, as equivalent to +2 qualification and issued orders accordingly.”

3. As the order passed by the learned Single Judge has been

complied with, nothing survives for adjudication in the writ appeal.

Accordingly, the writ appeal is dismissed. No costs. Consequently, the

connected miscellaneous petition is closed.
