                                                 JUDGMENT

The order and decreetal order dated 31.01.2014 passed in

C.M.A.No.7 of 2012, dismissing the above appeal and confirming the

order and decreetal order dated 29.02.2012 made in E.A.No.53 of 2011

in E.P.No.143 of 2010 in O.S.No.391 of 2004, is under challenge in the

present civil miscellaneous second appeal.

2. When the matter is taken up for hearing, the learned counsel

appearing for the appellant made a submission that he is not pressing this

civil miscellaneous second appeal.

3. Accordingly C.M.S.A.No.30 of 2021 stands disposed of as not

pressed. No costs. Consequently, connected miscellaneous petition is

closed.
