The suit has been filed for recovery of money. It is submitted by

the learned counsel for the respondent that the third respondents had

passed away long back. So far no steps have been initiated by the

appellant to implead the legal heirs of the third respondent and proceed

with the appeal. Hence, this Second Appeal is dismissed as abated.
