                                                                   ORDER

This is the first application filed by the applicants under Section 482 of Bharatiya Nagarik Suraksha Sanhita , 2023/Section 438 of Cr.P.C., 1973 seeking anticipatory bail in connection with Crime No.745 of 2025 registered at Police Station - Rahli, District - Sagar for the offence punishable under Sections 296-B, 118(1), 351(2) and 3(5) of BNS.

2. Learned counsel for the applicants has submitted that the opposite party/complainant party were trying to intervene in the land which is in the

possession of the applicants. Previously, a decree in the favour of the applicants was passed but the execution of that decree was pending before the Civil Judge, Senior Division, Rahli on the application of the wife of the applicant No.1 Khuman. In that case, the complainant party was directed to deposit Rs.66,000/- and they were released on the bail after submission of under taking. On the same incident, the FIR was lodged by the applicants on

2 MCRC-3088-2026 26.11.2025 in which, it has been clearly mentioned that at 11:30 AM, he was sowing the wheat crop through tractor on his field then Pappu Dangi, Bablu Dangi and Anand Dangi came and started making quarrel and started uttering filthy abuses. Anand Dangi assaulted him with the help of lathi, Pappu assaulted Rishiraj with the help of an axe and Yuvraj assaulted Bablu Dangi. Crime No.746/2025 was registered against the victim party for the same incident.

3. Learned counsel for the applicants has further submitted that in this case Crime No.745/2025 has been registered against the applicants. The incident has been stated to be on 26.11.2025 near about 12 PM and it is clearly mentioned that the applicants namely Khuman, Narendra and Rishi were present on the spot and the quarrel took place. The victim has suffered

no grievous injury. Pappu Dangi, Monika and Arti have suffered the injury and they have taken the name of the assailants in the counter case, hence, the applicants be granted the benefit of anticipatory bail.

4. Learned counsel for the State has also opposed the anticipatory bail application and has submitted that the complainant has suffered the grievous injury and other two persons have suffered injury, therefore, no case of anticipatory bail is made out.

5. Heard the parties and perused the case diary.

6. Looking to factual aspects of the case, this Court deems it appropriate to enlarge the applicants on anticipatory bail. Thus, without commenting anything on the merits of the case, the application is allowed.

7. It is directed that in the event of arrest, applicant No.1 Khuman

3 MCRC-3088-2026 Singh, applicant No.2 Narendra Singh and applicant No.3 Rishiraj shall be enlarged on bail on furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) each with one surety in the like amount each to the satisfaction of the Arresting Officer/Trial Court for their appearance before the concerned during the course of investigation or during trial, as the case may be.

8. It is further directed that the applicants shall abide by all the conditions as enumerated under Section 482(2) of BNSS.

9. The applicants are directed to cooperate with the investigating agency and shall also appear on the date and time, as directed by the Investigating Officer.

10. Accordingly, M.Cr.C. stands disposed of.
