                                                                 ORDER

Today, due to call of High Court Bar Association, Gwalior, Advocates are abstaining from court work.

This is first bail application under Section 483 of BNSS filed by the applicant for grant of bail.

The applicant has been arrested on 30.1.2026 by Police Station- Cantt. District Guna in connection with Crime No.64/2026, registered in relation to

the offence punishable under Section 4 (A) of Public Gambling (M.P.) Act, 1976 and Section 112 and 238 (A) of BNS.

The allegation against the present applicant is that he alongwith other co-accused Divyanshu alias Naino, Deepanshu, Shubham Sahu, Ram Gurjar, Ranu Khan, Rahul Dhakad, Varun Malviya, Deepak Ojha, Bharat Yadav, Monu Raghuvanshi, Babu Bhai, Ashish Sen, Halke Bhai, Mannu Soni,

2 MCRC-9569-2026 Navneet, Rohit Gupta alias Monty, Sonu Maharaj, Boomra Raghuvanshi and three other individuals formed a group or acted as members of a syndicate and, during cricket matches, engaged in online betting themselves as well as facilitated betting for others, thereby allegedly committing an organized crime.

According to pleadings of present anticipatory bail application, the present applicant is innocent and has been falsely implicated in the present case, as no offence as alleged by the prosecution has been committed by him and there exists no material on record to establish his complicity in the alleged crime. The allegations made in the FIR are vague and general in nature, and no prima facie offence under Section 4(A) of the Public Gambling (M.P.) Act, 1976, Sections 112 and 238(A) of the BNS is made

out against the applicant. No direct or indirect overt act has been attributed to him, he was not found at the spot of the alleged incident, and has been implicated solely on the basis of memorandum statements without any specific role being assigned in the FIR. No incriminating material, mobile phone, betting amount, electronic device, or any other article has been recovered from his possession linking him with the alleged offence. A similarly placed co-accused, Rohit Gupta alias Monty, has already been granted the benefit of bail by this Hon'ble Court vide order dated 12.02.2026 passed in M.Cr.C. No. 6844 of 2026. The case of the present applicant stands on identical footing, as the role attributed, nature of allegations, and surrounding circumstances are substantially similar. 3 MCRC-9569-2026 (M.P.), and there is no likelihood of his tampering with prosecution evidence. The trial is likely to take considerable time, therefore continued incarceration would amount to pre-trial punishment. The applicant is ready and willing to furnish adequate surety and abide by all terms and conditions imposed by this Hon'ble Court, hence he is entitled to be released on bail.

Considered the pleadings and perused the case diary. After considering the pleadings and perusing the case diary, but without expressing any opinion on the merits of the case, the present application is allowed. Accordingly, without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the trial Court/committal Court for his appearance on the dates given by the concerned Court.

This order will remain operative subject to compliance of the following conditions by the applicant:-

1. The applicant will comply with all the terms and conditions of the bond executed by him;

2. The applicant will cooperate in the investigation/trial, as the case may be;

3. The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police

Officer, as the case may be;

4. The applicant shall not commit any other offence during pendency of the trial, failing which this bail order shall stand cancelled automatically, without further reference to the Bench;

5. The applicant will not seek unnecessary adjournments during the trial; and

6. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

The Court expresses its appreciation for the able, efficient, and commendable assistance rendered by Shri Jai Prakash Bhargava on behalf of the Advocate General's Office Copy of this order be sent to the trial Court concerned for compliance. Certified copy as per rules.
