                                                                  ORDER

1. This is the first application filed by the applicant under Section 439 of Cr.P.C./under Section 483 of B.N.S.S. for grant of regular bail relating to Crime No.1/2026 registered at Police Station - Barwani, District Barwani (M.P.) for the offence punishable under Section 69 of BNS, 2023. The applicant has been arrested on 3.1.2026.

2. As per the prosecution story, marriage of the prosecutrix was solemnized in the year 2020 and from that wedlock, she was blessed with

two children. As she got married against the wishes of her family members, a report was lodged by them in which her husband was arrested and sent behind the bars. When the husband of the prosecutrix was in jail, she developed a friendship with the applicant, and in the year 2021, when her husband came out of jail, he came to know about the affair the prosecutrix was having with the applicant. 2 MCRC-6523-2026 she started residing with her parents. Around six months back, the prosecutrix informed the applicant that she is getting married, and he shouldn't interfere in that. At that juncture, the applicant assured her that he would marry her and would also take care of her children. On this assurance, on 14/09/2025, she went to Barwani, the applicant took her in a room, and made physical relations with her. Thereafter, she was taken to Indore, where they lived in a hut, and there, physical relations were made. On 04/12/2025, the prosecutrix again met the applicant, they lived in a rented room at Anjad, but the prosecutrix asked him to take her to his house. However, the applicant refused to do so and left her. Accordingly, the aforesaid offence has been registered against the applicant.

3. Learned counsel for the applicant submits that applicant is innocent

and has been falsely implicated in this case. Prosecutrix is aged about 26 years. Prosecutrix and applicant both were in relationship since 2021. Prosecutrix is a major and married lady having two children. FIR has been lodged belatedly. There is no previous criminal record of the applicant. He is in custody since 3.1.2026. The conclusion of trial will take considerable time, therefore, it has been prayed that the applicant may be released on bail.

4. On the other hand, learned counsel for State has opposed the grant of bail to the applicant and prayed for it's rejection.

5. Having taken into consideration all the facts and circumstances of the case, but without commenting on merit of the case, I am inclined to release the applicant on bail. Consequently, bail application under Section 483 of B.N.S.S. for grant of bail filed on behalf of applicant, stands allowed.

6. It is directed that applicant be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial Court, for his regular appearance before the trial Court during trial with a condition that he shall remain present before the concerned Court on all the dates fixed by it during trial. He shall abide by all the conditions enumerated under Section 480(3) of B.N.S.S.

7. This order shall be effective till the end of the trial. However, in case of bail jump and breach of any of the conditions of bail, it shall become ineffective.
