                                                                  ORDER

This is the third bail application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita , 2023/ 439 of Code of Criminal Procedure for grant of regular bail relating to FIR/Crime No.390/2025 registered at Police Station - Sironj, District - Vidisha (M.P.) (Now being tried through Principal FIR No.273/2024 at Police Station - Palera, District - Tikamgarh) for the offence punishable under Sections 111, 111(2), 111(4), 238(2), 316(2) and 318(4) of BNS, 2023 Section 6(1) Madhya Pradesh

Nikshepakon Ke Hiton Ka Sanrakshan Adhiniyam, 2000. The applicant is in custody since 09.07.2025. Earlier two bail applications i.e. M.Cr.C. No.34462/2025 and M.Cr.C. No.48397/2025 were dismissed as withdrawn vide order dated 16.9.2025 and 03.11.2025 respectively.

2. Learned counsel for the applicant has submitted that as per the order Annexure A-2 passed in WP No.38532/2025 dated 09.10.2025, nine cases

2 MCRC-3360-2026 were registered in the different districts of Madhya Pradesh, has been compiled and on that basis, the main case has stated to be of District - Tikamgarh and due to writ petition order, the bail application has been filed. As per para -11, the main case, registered as Crime No.273/2025 at Police Station - Palera, District - Tikamgarh and other cases have been clubbed with this case and has been directed that those cases be treated as the statement recorded under Section 161 of the Cr.P.C. and on that basis, he has filed the bail application before this Court.

3. Learned counsel for the applicant has further submitted that the previous bail application of this applicant was dismissed as withdrawn with the liberty to renew the application after two months and in the same circumstances, other co-accused persons namely Vinod Tiwari, Jiyalal Rai,

Subodh Rawat, Vijay Shukla, Rahul Yadav and Ravishankar @ Ravi have been released on bail on the ground that these applicants were the agent of the so called LJCC Inter State Co-operative Society.

Learned counsel for the applicant has further submitted that the applicant is neither the director nor the member of the society, he was only the agent and as the society was closed and the payment was not made to the investors, this case has been registered, hence, the applicant is entitled to be released on bail.

5. Learned counsel for the State has opposed the bail application and has submitted that the applicant was collecting the money but was not depositing in the account of the society and huge amount of investors i.e. Rs.10,76,660/- was taken and misappropriated the applicant and other co-

3 MCRC-3360-2026 accused, hence, the applicant is not entitled to be released on bail.

6. Heard the parties and perused the case diary.

From perusal of the record, it is clear that LJCC (Lastinet Janhit Co-operative Society Limited) whose owner were Sameer Agrawal, Pankaj Agrawal, Alok Jain, partner was Sutikshna Saxena, Madhay Pradesh Head was Ravi Tiwari, Finance Manager was Rahul Yadav, Branch Manager of Vidisha was Angad Kushwaha and Branch Manager of Sironj was Virendra Kushwaha and this applicant and along with other co-accused persons were the agents of the company and from the investors Rs.100/- per day and lump sum amount of 20 days and 10 days, per day amount was taken by them to deposit in the Co-operative Society with the assurance that they will get a good amount of return and on that basis, 11 persons have invested Rs.10,76,660/-.

It is also alleged that all of sudden the company was closed and this applicant after closure of the company, was collecting the investment amount but that amount has not been refunded by the company to the investors, thus, the main offenders are the owner, directors and managers of the company and different districts of Madhya Pradesh, the cases are registered against the company.

Looking to the factual aspects that whether the applicant was aware about the fact that the company will be closed or there was prior intention of the applicant that invested money shall not be returned to the investors, at this stage, it cannot be inferred, coupled with the fact that trial will take time

to be concluded, this Court deems it appropriate to enlarge the applicant on

4 MCRC-3360-2026 bail, therefore, without commenting anything on the merits of the case, this bail application is allowed.

It is directed that the applicant shall be released on bail on his furnishing personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial Court concerned for his appearance before the said Court on all such dates as may be fixed by that Court in this regard during the pendency of trial.

11. It is further directed that the applicant shall comply with the provisions of Section 480(3) of BNSS.

12. Accordingly, Misc. Criminal Case stands disposed of. C.C. as per rules.
