                                                                    ORDER

This first application under Section 482 of The Bhartiya Nagrik Suraksha Sanhita has been filed on behalf of the applicant for grant of anticipatory bail.

2. Applicant apprehending his arrest in connection with Crime No. 395/2025 of Police Station-Samaan, District-Rewa (MP) for commission of

the offences punishable under Section 420 of IPC has knocked the portal of this Court for grant of anticipatory bail.

3. Prosecution story in brief is that applicant sold land forming part of Survey No. 519/2, 519/4, 519/7 after forging various documents.

4. Learned senior counsel for the applicant submits that in the instant case, FIR has been registered on 09.06.2025 and period of incident is from

2 MCRC-42615-2025 13.11.2002 to 13.10.2008. It is urged that original owner of the land was one Mahaveer and Mahaveer partitioned the land among his sons. Survey No. 519/2 was sold in the year 2001 by Rakesh to one Shubhangi and another but Rakesh did not make any complaint during his life time. It is urged that wife of Rakesh Kumar, Smt. Savitri Devi filed a civil suit with respect to sruvey No. 519/2, which was dismissed. Appeal against aforesaid judgment is pending in Rewa District Court. Further, private complaint was filed by Pramod Kumar Mishra under Sections 420, 473, 467, 476, 464, 471 and 468 of IPC and it was dismissed by the trial Court on 09.05.2013 and this order has not been challenged in any superior court. After aforesaid civil proceeding as well as private complaint, instant FIR was filed on 09.06.2025. Applicant is a government servant. There is no chance of absconding of

applicant. Applicant is ready to abide by all the conditions whatsoever imposed by this Court. On these grounds, learned counsel for the applicant prays for grant of anticipatory bail.

Per-contra, learned counsel for the objector as well as learned counsel for the State, after referring to various documents, it is urged that in the instant case, various documents have been forged by the applicant and he has sold the land. Therefore, applicant is not entitled to be released on the anticipatory bail.

Having regard to the factual matrix of the case and undisputed fact that earlier a civil suit was filed in the instant case and appeal is pending against dismissal of aforesaid civil suit and private complaint was also filed and it was dismissed in the year 2013 and this order has not been challenged

3 MCRC-42615-2025 till today and present FIR has been registered on 09.06.2025, without expressing any opinion on the merit of the case, I am of the view that it is a case in which applicant may be released on bail. Consequently, anticipatory bail application filed on behalf of applicant stands allowed.

It is directed that in the event of his arrest, applicant be released on bail on his furnishing a personal bond of Rs.15,000/- (Rupees Fifteen Thousand Only) with one solvent surety of the like amount to the satisfaction of the Arresting Officer. It is also directed that the applicant shall abide by the conditions as enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. It is made clear that applicant shall appear before the Investigating Officer as & when he is so directed and cooperate with the investigation and he shall also appear before the Trial Court failing which his bail shall automatically stand cancelled without further reference to the Court.
