No.11209/2025, seeking suspension of sentence on behalf of appellant No.1 Ramji @ Ramkisi Kori, appellant No.2 Rajendra Kori, appellant No.3 Deepak Kori and appellant No.4 Rajnish Kori. Similarly, Shri Alkesh Kumar Mishra, learned counsel has filed I.A. No.10113/2025, seeking suspension of sentence on behalf of appellant Sushil Kori.
Both these appeals are filed being aggrieved of the judgment
dated 02.04.2025 passed by learned 4th Additional Sessions Judge, Rewa (M.P.) in ST No.217/2024 whereby appellants have been convicted as under :-

It is submitted that appellants are innocent. They have been falsely implicated.
Shri Nitin Gupta, learned Public Prosecutor for the State, in his
3 CRA-4309-2025 turn, informs that firstly, DNA report is positive qua appellant No.1 Ramji, appellants in other appeal namely Karun Kori, Ramesh Gupta and Sushil Kori. All the accused persons have been properly identified, inasmuch as, identification of Ramji is Ex.P-8, Rajendra is Ex.P-13, Deepak is Ex.P-12, Rajnish is Edx.P-11 and Sushil Kori is Ex.P-10.
It is also pointed out that in para 165 onwards learned trial Court has analyzed the video files except for Deepak whose presence has been said to be not a concreate, inasmuch as trial Court has admitted in para 177 that his face is not fairly visible whereas has certified presence of other seven accused persons, namely, Ravesh Gupta, Lavkush Kori, Rajendra Kori, Sushil Kori, Rajnish Kori, Garun Kori and Ramji @ Ramkisi Kori, present is a judgment which is not only well reasoned but also very elaborate in discussing each and every aspect of the evidence.
When all these facts are taken into consideration, then the only ground on which benefit of doubt can be given to Deepak as his face is not clear and, secondly it is admitted by the prosecutrix that police had shown photographs of several persons prior to their arrest and, therefore, we extend benefit of doubt to appellant No.3 Deepak and allow his application (I.A. No.11209/2025, so far as it relates to appellant No.3 Deepak Kori) for suspension of sentence and released him on bail.
It is directed that on depositing of fine amount, if not already deposited and on furnishing personal bond to the tune of Rs.50,000/-
(Rupees Fifty Thousand Only) with two sureties in the like amount to
4 CRA-4309-2025 the satisfaction of the Trial Court for his appearance before the Trial Court on 13.01.2026 and on all subsequent dates as may be fixed by the concerned Court, the execution of remaining part of the jail sentence of appellant No.3 Deepak Kori shall remain suspended and he be released on bail till final disposal of this appeal.
However, in view of positive DNA report and also the role of each of the accused specifically shown in the video, application on behalf of appellant No.1 Ramji @ Ramkisi Kori, appellant No.2 Rajendra Kori, appellant No.4 Rajnish Kori and Sushil Kori deserve to be fail and are hereby dismissed.
Accordingly, I.A. No.11209/2025 and I.A. No.4330/2025 are disposed of.
