Heard on I.A.No.13210/2025, first application seeking suspension of sentence on behalf of the appellants, who have been convicted under sections 452, 147, 148, 323 r/w section 149, 324 r/w section 149, 325 r/w section 149 of the IPC and sentenced to undergo RI for 2 years with fine of Rs.1000/-, RI for 2 years with fine of Rs.1,000/-, RI for 2 years with fine of Rs.1000/-, RI for 6

months with fine of Rs.1000/-, RI for 2 years with fine of Rs.1000/-, RI for 2 years with fine of Rs.1000/- with further default stipulation respectively vide judgment dated 28.07.2025 in ST No.05/2024 by 5th ASJ, Dr.Ambedkar Nagar, district Indore.

Counsel for the appellants submits that the conviction and sentence passed by the trial court against the appellants are bad in

2 CRA-8955-2025 law. They have every hope of success in this appeal. The final hearing of this appeal will likely to take long time. They have already undergone substantial period of sentence, hence prayed for suspension of sentence and release of the appellants on bail.

Counsel for the State has opposed the application. Considering the facts and circumstances of the case and the arguments advanced by the counsel for the parties, without commenting on the merit of the case, the application is allowed and it is directed that the execution of remaining jail sentence passed against the appellants shall remain suspended and they be released

on bail upon each of them furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the trial court for their appearance before the Registry of this Court on 09.03.2026 and on such further dates as may be fixed in this behalf by the Registry during the pendency of this appeal.
