Shri Yogesh Kumar Gupta - Advocate for the petitioner.

Shri Jayesh Yadav appearing on behalf of Advocate General[r-1].

                                Heard on admission.
                                Admit.
List for final hearing in due course.

Heard on I.A.No.15622/2025, first application seeking suspension of
sentence on behalf of the petitioner.
This criminal revision is preferred against the judgment dated
07.11.2025 in criminal appeal no.184/2022 by the Vth ASJ, Indore whereby
the appellate court has dismissed the appeal and affirmed the judgment dated
21.06.2022 in Criminal Case No.5900005/2012 by JMFC, Indore convicting
the petitioner under section 3 r/w 7(1)(A)(2) of the Essential Commodities
Act, 1955 and sentencing him to undergo RI for 1 year with fine of
                          Rs.2,000/- with further default stipulation.

Counsel for the petitioner submits that the courts below have wrongly
convicted and sentenced the petitioner. He has every hope of success in this
revision. The final hearing of this revision will likely to take long time. He
has already undergone substantial period of sentence, hence prayed for
suspension of sentence and release of the petitioner on bail.
Counsel for the State has opposed the application.

7:14:00 PM 2 CRR-5434-2025 Considering the para 21 of the judgment of the trial Court and the arguments advanced by the counsel for the parties and the fact that the sentence passed against the petitioner is a short one, without commenting on the merit of the case, the application is allowed and it is directed that the execution of remaining jail sentence passed against the petitioner shall remain suspended and he be released on bail upon his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the trial court for his appearance before the Registry of this Court on 16.03.2026 and on such further dates as may be fixed in this behalf by the Registry during the pendency of this revision.
