                                                                     ORDER

It is submitted that the applicants are in jail. The applicants are aggrieved by the judgment dated 3.9.2025 passed in Cr.A. No.96 of 2025 by 17th Additional Sessions Judge, Jabalpur, M.P. arising out of judgment dated 17.2.2025 passed in Criminal Case No. R.C.T. No.5402582 of 2012 by Judicial Magistrate, Ist Class Jabalpur convicting and sentencing the applicants to undergo R.I. for 6-6 months and fine of

Rs.2000/-2000/- each under Section 325/34 of IPC and for two injuries under Section 323/34 of IPC an imprisonment of "till rising the court" and fine of Rs.100/-Rs.100/- each was awarded with default stipulation. The compensation was to be paid to the complainant out of the fine amount.

2. An appeal was made before the appellate court and vide judgment dated 3.9.2025 the appeal was dismissed in Appeal No.96 of 2025.

3. Learned trial court acquitted Pappu @ Raj Kumar Sonkar.

4. Learned counsel for the complainant submits that the complainant has compromised the matter. The complainant who is present in the court submits that Shyambaba is her brother-in-law and Rambaba is her husband who are in jail. They have all compromised the matter with the accused.

5. On perusal of the record, it is seen that the matter was sent to record the compromise statement. Learned Registrar (J-2) dated 14.11.2025 has recorded the statements of the following complainant and accused parties namely :-

Shyam Baba Sonkar aged 49 years, Son of Late Nandan Sonkar, Ram Baba Sonkar aged about 49 years, Son of Late Nandan Sonkar,

Smt. Chandrakala Sonkar, aged 45 years, W/o Ram Baba Sonkar, Pradeep Sonkar, aged 61 years, S/o Laljee Sonkar, Rajesh Sonkar, aged 60 years, S/o Laljee Sonkar, Rakesh Sonkar, aged 60 years, S/o Laljee Sonkar,

6. Pradeep Sonkar, Rajesh Sonkar and Rakesh Sonkar were produced under custody from the jail. Learned Registrar (J-II) has recorded that the aforesaid complainant party and the accused party have got recorded their statements without any threat and inducement and settled their dispute and the compromise appears to be genuine and accordingly verified.

7. Therefore, it is found that the compromise is free and with their consent. Thus, in view of aforesaid, the application is allowed and the applicants are acquitted from the charges under which they have been convicted by learned trial court.

8. Disposal of the case property shall be as per judgment of the trial court.

9. The applicants be released forthwith if not required in any other offence.

10. The applicants shall be entitled for return of the fine amount, if already deposited by them.

11. Accordingly this revision stands disposed of.
