ORDER
By this petition preferred under Article 226 of the Constitution of India, the petitioner has challenged the permit (Annexure P/3) issued by the respondents in so far as it has considered the date of manufacture of the vehicle of the petitioner as the relevant date instead of considering the date of its registration for the purpose of fixation of the age limit of the vehicle.
02. Learned counsel for the petitioner has drawn attention to an order
dated 11.12.2023 passed in W.P. No.30235/2023 (Virendra Singh Vs. State of M.P. and Others) wherein the State Transport Office was directed to consider the date of registration of the vehicle. However, it does not appear that the said aspect of the matter has been considered by the respondents.
03. Thus, respondent No.2 is directed to take into consideration the judgment of this Court in Virendra Singh (supra) and to redecide the issue as regards the relevant date for fixation of age limit of the vehicle of the

petitioner and also by taking into consideration the relevant applicable rules in that regard. It is made clear that the grant of permit in favor of the petitioner is not being interfered with.
With the aforesaid directions, petition stands disposed off.
