                                                                ORDER

This is sixth bail application filed by the applicant under Section 439 of the Cr.P.C./483 of BNSS for grant of regular bail relating to FIR No. 112/2022 dated 22.02.2022 registered at Police Station-Misrod, District-Bhopal for the offence under Sections 420, 406, 467, 468, 471, 419, 201 and 34 of IPC and Section 6(1) of MP Nikshepko Ke Hito Ka Sarnkshan Adhiniyam. They are in detention since 14.09.2022.

2. As per the prosecution story, on 22.02.2022, Rajkumar Saxena filed an application in writing before police alleging that Sunil Kumar Tiwari, Director of

Classic Machinery Mart company, Gulshan Kumar, Branch Head, Mukesh Kashyap, Finance Head, Ajay Mishra and Pramod Kumar, Coordinators and other allured the complainant to purchase machine for manufacturing Dona, pattal and disposable plates and received Rs. 5,00,000/- in installments from the complainant but they neither gave the machines nor returned the money to the complainant till the due date and suddenly closed the office and ran away. 2 MCRC-21400-2025 his real name was Rohit Kumar Singh S/o Ramswaroop Singh and Mukesh Kashyap's proper name was Rana Pratap Singh S/o Anjani Kumar Singh. They both had committed cheating and fraud with the complainant and others by forging voter ID and other documents. After investigation, charge sheet has been filed.

3. Learned counsel for the applicants has submitted that applicant has not committed any offence. He is innocent. He has been falsely implicated. Co- accused Rohit Pratap Singh has already been enlarged on bail by the co-ordinate Bench of this Court vide order dated 24.04.2023 passed in M.Cr.C.No.8031/2023. It is further submitted that bail application has been filed on the ground of delay in trial. Only four witnesses have been examined out of 61 till now. Therefore, it has been prayed that the applicant be released on bail.

4. Learned counsel for the State submitted that his first bail application

M.Cr.C.No.35623/2023 was dismissed on merits thereafter, his four bail applications were dismissed as withdrawn. SLP No.14064/2024 has been filed before the Hon'ble Apex Court which has been withdrawn vide order dated 10.04.2024. It is further submitted that in this case present applicant alongwith other co-accused persons, collected an amount of Rs.2,45,38,600/- from number of persons on promise of installing machines. Applicant has made forged document. He has a criminal background of six cases in Madhya Pradesh and West Benga of similar nature. Material witnesses are yet to be examined. He further stated that this is a heinous offence and in such type of offences merely on the ground of delay in trial and long incarceration, the accused is not entitled to grant of bail. Learned counsel has placed reliance in the judgment delivered by the Hon'ble Superme Court in the case of Gurwinder Singh Vs. State of Punjab & another (Criminal Appeal No.704 of 2024) and in the case of Kalyan Chandra Sarkar Vs.

3 MCRC-21400-2025 Rajesh Ranjan @ Pappu Yadav and Another (2004) 7 SCC 528 . In view of the above, it is prayed that bail may not be granted to the applicant.

5. It is directed that the trial Court will expedite the trial as early as possible. The Commissioner, Bhopal is directed to ensure the presence of the prosecution witnesses before the trial Court and the trial Court is also directed to take steps for the presence of other prosecution witnesses.

6. Learned trial Court is also directed to send the progress report of the trial in every three months to the Principal Registrar (Vigilance) through the concerned Principal District and Sessions Judge.

7. Principal Registrar (Vigilance) will monitor the progress of the case.

8. Registry is directed to send a copy of this order to the concerned trial Court, Principal Registrar (Vigilance), Jabalpur and Commissioner, Bhopal for necessary compliance.

9. With the above directions, the application is disposed of. Certified copy as per rules.
