Counsel appearing for petitioner submitted that no offence under Section 377 of IPC is made out against petitioner in view judgment passed by Coordinate Bench of this Court in the case of Manish Sahu Vs. State of
Madhya Pradesh & Anr. reported in 2024 SCC OnLine MP 2603 . It is submitted that family members of the petitioner were roped in for committing offences. There is only marital dispute between parties and to make offence serious in nature, allegations under Section 377 of IPC is made against petitioner.
2. Issue notice to respondents on payment of PF within seven days. Notices be made returnable within four weeks.
3. Till next date of hearing, further proceedings in S.T.No.150/2023
before 10th Additional District and Sessions Judge, Bhopal shall remain stayed.
4. List this matter after four weeks.
5. Certified copy as per rules.
