This revision is admitted for final hearing.

Heard on I.A.No.6756/2024 which is an application under Section 397/401 of the Cr.P.C. for suspension of sentence and grant of bail to the applicant.

The applicant has been convicted under Sections 457, 354 and 506-II of Indian Penal Code and has been sentenced to undergo R.I. for 1 year on each count with fine of Rs.2000/-, Rs.1,000/- and Rs.1,000/- respective with default stipulations, by the learned Additional Sessions Judge, Junnardev District Chhindwara vide judgment dated 1.3.2024 passed in Criminal Appeal No.57/2022 (State of Madhya Pradesh v. Rupendra).

Learned counsel for the applicant submits that the applicant is in judicial custody. He further submits that the applicant is ready to abide by the conditions imposed by the Court, if bail is granted to him. He further submits that the final hearing of the revision will take a long time and if the applicant remains in jail, the purpose of filing this revision would be frustrated.

Considering the aforesaid facts and circumstances of the case, without expressing any opinion on the merits of the case, this Court is inclined to consider and allow the application. Accordingly, I.A. No.6756/2024 is

allowed.

It is directed that subject to depositing the fine amount, if not already deposited and on furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only)each with one surety each in the like amount to the satisfaction of the trial Court concerned, the custodial sentence of applicant shall remain suspended and he shall be released on bail for securing his presence before the trial Court concerned on 09.09.2024 and on such other dates as may be fixed by the trial Court in this regard during pendency of this revision.
