These petitions coming on for admission this day, the court passed the
following:
ORDER
Since the controversies involved in these cases are identical in nature, therefore, these writ petitions are analogously heard and being decided by this common order. Facts of W.P. No.11397 of 2023 are narrated hereunder.
The petitioner has filed the present petition under Article 226 of the Constitution of India seeking benefits of Fifth, Sixth & Seventh Pay Commission.
02. Initially, the petitioner was engaged as daily wager by the respondents on 01.08.1990. The petitioner retired from the service on 31.07.2018 upon attaining the age of superannuation. According to the petitioner, he was entitled for regularization and special pay as per the Circulars dated 16.05.2007, 06.09.2008 & 29.09.2014. It is further submitted that as per the aforesaid Circulars, juniors to the petitioner working in the same Department were regularized and given the benefit of Fifth & Sixth Pay Commission. The petitioner also approached this Court by W.P. No.2507 of 2016, which was allowed by giving direction to the respondents to grant the benefits of scale as well as arrears keeping in view the Fifth & Sixth Pay Commission. The respondents have not complied the aforesaid order, therefore, the petitioner submitted a representation. The respondents gave reply dated 12.07.2018 stating that all the benefits have been granted and no further benefit are due to be granted.
03. The petitioner again approached this Court by way of W.P. No.26794 of 2018 which was disposed of with the direction to consider the
grievance of the petitioner in respect of non-payment of arrears of Fifth & Sixth Pay Commission. Again the petitioner submitted a representation which came to be rejected vide order dated 29.06.2020 in light of the Circular dated 07.10.2016, thereafter, the petitioner gave a legal notice and filed the present petition claiming the benefits of Fifth, Sixth & Seventh Pay Commission.
04. The respondents filed a reply by submitting that the petitioner has suppressed the material fact that he submitted an option to get the benefit of Circular dated 07.10.2016. Although W.P. No.2507 of 2016 was allowed for grant of benefits of Fifth & Sixth Pay Commission but thereafter, the State Government issued a Policy for daily wager granting them the permanent status vide Circular dated 07.10.2016. The petitioner submitted an undertaking on 23.08.2017 and got the benefit of permanent status w.e.f. 01.09.2016. The petitioner has been granted the dearness allowance from the date of his initial appointment, i.e. 01.08.1990. Therefore, the petitioner has foregone all his rights to claim benefits of Fifth & Sixth Pay Commission and the writ petition is liable to be dismissed.
05. The petitioner has not filed any rejoinder to dispute the aforesaid facts.

It is correct that in light of the judgment delivered by the Apex Court in the case of Ram Naresh Rawat v/s Ashwini Ray & Others reported in (2017) 3 SCC 436, the State Government issued a Circular dated 07.10.2016 by issuing directions to all the Department to grant of benefit of 'Sthaikarmai' to daily rated employee in their respective skilled, unskilled and semiskilled category. They were directed to be given the benefits from 01.09.2016 and dearness allowance which is at present 125%. They shall be entitled for
increment from September, 2017. The gratuity amount has also been ascertained in the said policy. Although as per Clause - 3, the benefits had already been given to daily rated employee in compliance of order of High Court and they were protected, but in the present case, no order was passed for grant of benefit of Fifth & Sixth Pay Commission to the respondents. However, the petitioner gave an undertaking to accept the benefit of Circular dated 07.10.2016. Thereafter, Circular dated 28.09.2017 was issued granting all the benefits under the Circular dated 07.10.2016.
07. So far as grant of benefits of Fifth, Sixth & Seventh Pay Commission are concerned, when the Circular dated 07.10.2016 was issued which was made applicable from 01.09.2016, Sixth Pay Commission had already been implemented, therefore, the State Government decided the pay scale to be given to skilled, unskilled and semiskilled category of Sthaikarmis on the basis of Sixth Pay Commission. Once the petitioner had been fixed in pay-scale of respective category, now the benefit of Fifth & Sixth Pay Commission cannot be claimed as that has been been taken care by the State Government by fixing their pay-scale in all the three categories.
08. So far as the benefit of Seventh Pay Commission is concerned, vide notification dated 20.07.2017, the State Government notified Madhya Pradesh Pay Revision Rules, 2017. Clause - 2.6(viii) clearly says that these rules will not be applicable to declare permanent employee under the Circular dated 07.10.2016, therefore, by virtue of this statutory rules 'Sthaikarmies' have been kept out of the Pay Revision Rules. Unless validity of these rules are challenged, no relief can be granted to the petitioner.
09. In view of the above, Writ Petition stands dismissed. Since the petitioners in connected writ petitions also, i.e. W.P. Nos.28919 of 2023, 28920
of 2023 & 31377 of 2023, are claiming the benefit of Fifth, Sixth & Seventh Pay Commission along with consequential benefits, therefore, the connected writ petitions also stand dismissed with the same terms and conditions of the order passed in W.P. No.11397 of 2023.
Let a copy of this order be kept in the connected petitions also.
