Heard on IA No. 1412/2024, which is an application filed under Order 14(b) of CPC for dispensing with service of notice on respondent Nos. 6 to 8.
Considering the averments mentioned in the application, which is
supported by affidavit and looking to the fact respondent Nos. 6 to 8 were defendant Nos. 1, 3 and 4 before the trial Court and trial Court proceeded against them ex-parte on 11/03/2014 and 26/03/2016, same is allowed and appellant is dispensing with service of notice on respondent Nos. 6 to 8 at their own risk and cost.
Accordingly, IA No. 1412/2024 stands disposed of. Also heard on IA No. 10866/2018, which is an application filed under Order 41 Rule 5 of CPC for stay on execution of judgment and decree dated 10/08/2018.
Earlier vide order dated 22/08/2022 parties are directed to maintain status quo as exists on that day.
Considering the averments mentioned in the application,which is supported by affidavit, interim granted on 22/08/2022 is hereby made absolute.
Accordingly, IA No. 10866/2018 stands disposed of. List the appeal for final hearing in due course.
