Learned counsel for the petitioner placed order dated 07-10-2020 passed by Writ Appeal No.823/2020 whereby after considering the claim of petitioner, his appeal was allowed along with interest from the date of entitlement.

Counsel for the respondents/State opposed the prayer on the ground of

judgment of Apex Court in the case of Rushibhai Jagdishchandra Pathak Vs. Bhavnagar Municipal Corporation 2022 SCC OnLine SC 641 whereby 3 years has been prescribed as maximum period in which interest can be granted to the employee.

Issue notice to the respondents on payment of process fee within seven days by RAD mode, returnable within four weeks.
