Heard on I.A.Nos.3904/2020, which is an application for condionation of delay in filing this appeal.
This appeal has been preferred after a delay of 4 years, 10 months and 15 days, which was also including the period of Covid-19, as the original judgment and decree has been passed on 02.02.2015; whereas this appeal has been preferred on 11.12.2020.
A s per the order dated 10.10.2023 passed in connected First Appeal No.841/2020, this Court has condone the delay in the same factual matrix on the condition that "the appellant shall not be entitled to claim any interest in respect of period of delay".
In view of the above, I.A.Nos.3904/2020 stands allowed and delay is
hereby condoned.
Let the record be requisitioned.
Shri Salabh Sharma, learned Government Advocate for the respondent No.1/State and Shri Vivek Patwa, learned counsel for respondent no.2/NVDA are already appeared and Shri Patwa has already filed the Vakalatnama.
